ユネスコ学習権宣言

「人にされて嫌なことは人にするな」
下記はカナダのサイトですが、「人にされて嫌なことは人にするな」という基本戒律は日本の神道をふくめて世界の21の主要宗教のすべてに見られることが指摘され、その文言が引用されています。

一部、サイトの内容に間違いがあります。ヒンドゥー教の文言として誤って中国の孟子の言葉が引用されています。世界の宗教の中でもヒンドゥー教だけは人間の平等を認めないだけでなく積極的に否定します。生まれ落ちたカーストの序列と差異がすべてなのです。
またキリスト教だけが「人にして欲しいことを人にしなさい」と戒律が肯定形になっていることにも注意して下さい。ここにキリスト教徒が独善的になる原因があります。(関 )

国連・子どもの権利委員会のコメント、2001、2,8
この「国連・子どもの権利委員会のコメント、2001、2,8」は、大変、面白い内容なのですが、ここでは、世取山洋介氏の仮訳文を、二項までご紹介しておきます。
「子どもの権利条約」の第29条は「教育の目的」ですが、いま(2006年5月段階)、国会で議論されている「教育の目的」という次元とはかなり違うことを主張しているようです。それは、教育目的を「国家」が法定化するものとは異なる解釈です。私は、特にその中の、2の文書に注目します。

そこには、「子どもをエンパワー(元気に)すること」「ライフスキルの提供」「人権を享受する能力の強化」「人権に関する適切な価値を吹き込まれた文化」「子どもをエンパワーすることが目的で、そのような意味の「教育」は正規の学校教育をはるかに超えていく、生活経験と学習のプロセスを含む」 などのような、極めて、興味ぶかい文章があるわけですが、こういうことを議論しながら「公教育」の再生に向けて考えるならば少しは意味はあるのですがーー。

つまり、教育とは、子どもをエンパワーするためのもので、人権ということの価値・文化を享受し促進するために
あるということです。これで、十分なんです。【白崎・記】

子どもの権利条約 第29条1項
1 締約国は、子どもの教育が次のことを指向すべきことに同意する。
(a) 子どもの人格、才能、ならびに、精神的および身体的能力をその可能最大限度まで発達させること。
(b) 人権および基本的自由ならびに国際連合憲章にうたう原則に対する尊重を発達させること。
(c) 子どもの父母、子ども自身の文化的アイデンティティ、言語および価値、子どもの居住国および出身国の国民的価値観、ならびに自己の文明と異なる文明に対する尊重を発達させること。
(d) 理解、平和、寛容、および両性の平等に関する精神、ならびに、すべての人民、民族的、国民的、宗教的集団、および先住民の間の友好の精神に従い、自由な社会における責任ある生活のために子どもを準備させること。
(e) 自然環境に対する尊重を発達させること。

一般的注釈1(2001):教育の目的

(a)第29条1項の意義

1. 条約29条1項の重要性は広範囲にわたる。本条項に定められ、すべての締約国によって合意された教育の目的は、本条約の本質的な価値、すなわち、あらゆる子どもが生まれながらに有している人間としての尊厳および平等かつ不可侵の権利を促進し、援助し、かつ保護する。

 条約29条1項の5つの号に定められているこれらのすべての目的は、発達に関する子どもの特別のニーズおよび子どもの発達しつつある多様な能力を考慮するものであり、子どもの人間としての尊厳および子どもの権利の実現と直接に結びついている。これらの目的とは、人権に対する尊重の発達(29条1項(b))、アイデンティティおよび帰属(affiliation)に関する感覚の強化(29 条1項(c))、子どもの社
会化および他者との主体的交流(interaction)(29条1項(d))、および子どもの環境との主体的交流(29条1 項(e))を含む子どもの可能性すべての全面的な発達(29条1項
(a))である。

2. 29条1項は、28条において認められている教育に関する権利を、子どもの権利および子ども固有の尊厳を実現する質的内容によって補充するだけでない。本条項は、教育が子ども中心的なもの、子どもに役立つもの、および子どもをエンパワーするものである必要性を強調する。さらに、教育のプロセスが、29条1項に表明されているまさにその原則に基づく必要性を強調する(1)。

 あらゆる子どもが権利を有する教育は、子どもにライフ・スキルを提供し、すべての範囲の人権を享受する子どもの能力を強化し、かつ、人権に関する適切な価値を吹きこまれた文化を促進するよう設計(design)されたものである。子どものスキル、学習能力、その他の能力、人間としての尊厳、および自尊心と自信を発達させることにより、子どもをエンパワーすることが目的なのである。

 このような意味の「教育」は、正規の学校教育をはるかに超えて、その人格および才能と能力を発達させ、かつ、社会において十全かつ満足のいく生活を送ることを子ども個人および子ども集団に可能とする広い範囲にわたる生活経験と学習のプロセスを含むのである。
